Welcome to Tailed, the platform (the "Platform") for sports bettors ("Bettors") and their subscribers ("Subscribers"). Please read these Terms of Service (these "Terms") carefully because they constitute a binding agreement between Tailed, Inc. ("Tailed", "we", "us", "our") and you in your capacity as a user of the Platform, whether as a Bettor or as a Subscriber ("Member", "you", "your").

Account

Account Creation

If you are a Bettor, you become a Member by signing up on the Platform and accepting these Terms and a Bettor Usage Agreement. As a Bettor, you'll be bound by these Terms and the Bettor Usage Agreement.

If you are a Subscriber, you become a Member by signing up on the Platform and accepting these Terms. Your email or phone number is your username. To login to your account, a verification code is sent to your email or phone. We like to keep things simple!

Agreement to Terms

By accepting these Terms on the Platform, or if your account was already created, by continuing to use the Platform, you agree to be bound by these Terms. If you do not agree to be bound by these Terms, do not use the Platform. By agreeing to be bound by these Terms, you represent and warrant that you are at least 18 years old and have not been previously suspended or removed from the Platform.

Platform Use

The Platform allows Bettors to share their sports betting picks, insights, and track records with Subscribers. Bettors can integrate their sportsbook accounts to provide transparent, verified performance data. Subscribers can follow Bettors, access their picks, and engage with their community.

Subscriptions and Payments

Bettors may offer subscription tiers to provide premium content and access to their picks and community. Subscribers agree to pay the subscription fees as determined by the Bettor. All payments are processed through the Platform's secure payment system. Subscription fees are non-refundable except as required by law.

Content and Conduct

You are responsible for all content you post on the Platform. You agree not to post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. You also agree not to impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity.

Intellectual Property

The Platform and its original content, features, and functionality are owned by Tailed and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of content you post on the Platform, but grant Tailed a license to use, display, and distribute such content in connection with operating the Platform.

Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.

Limitation of Liability

In no event shall Tailed, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Platform.

Disclaimer

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. Tailed makes no representations or warranties of any kind, express or implied, as to the operation of the Platform or the information, content, or materials included on the Platform. The picks, predictions, and advice provided by Bettors are for informational and entertainment purposes only and should not be considered as professional betting advice.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes to these Terms, we will notify you by updating the date at the top of these Terms and, in some cases, we may provide you with additional notice. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
